Important NY DMV Point System Changes Effective February 2026

There have recently been significant changes to the New York State Department of Motor Vehicles (DMV) point system taking effect in February 2026. These changes materially increase the impact of traffic violations and make it easier for drivers to reach license suspension thresholds.

WHAT IS CHANGING

• The DMV will now count points over a 24-month period instead of 18 months.
• Accumulating 10 points within 24 months may trigger a license suspension or DMV hearing.
• More violations now carry points, including offenses that previously resulted in fines only.

HOW POINTS ADD UP QUICKLY

Many drivers are surprised to learn how quickly points can accumulate under the revised system:

• Speeding 1–10 mph over the limit: 3–4 points
• Speeding 11–20 mph over the limit: 4 points
• Speeding 21–30 mph over the limit: 6 points
• Cell phone or texting while driving: 5–6 points
• Failure to yield to a pedestrian: 3–5 points
• Passing a stopped school bus: 5–8 points
• Reckless driving: 5–8 points
• Red light or stop sign violations: 3 points
• Unsafe lane changes or improper passing: 3 points

Multiple low-point violations can now combine to place your license at risk much faster than under prior rules.

WHY THIS MATTERS

• Points remain relevant for a longer period of time.
• Fewer violations are required to trigger DMV intervention.
• Insurance companies often use point totals to increase premiums.
• Professional, commercial, and rideshare drivers face heightened employment risk.

WHAT YOU SHOULD DO
