Step 1: Exercise Your 5th and 6th Amendment Rights

If you are driving while impaired and are questioned by the officer, any admissions made by you can be used against you at the time of trial. Remain silent and do not give a statement under these circumstances. The Fifth Amendment right to remain silent allows the accused to refuse to answer a question or provide a comment to law enforcement. Those accused should exercise their fifth amendment to avoid incriminating themselves.

Step 2: Call an Attorney from Police Custody
